Crossrow offers this website, including all information, tools and Services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms, conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers and contributors of content.
Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by them. If you do not agree to all of these Terms, you may not access the website or use any Services.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
YOUR STATUTORY RIGHTS
Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If any part of these Terms conflicts with your statutory rights, your statutory rights prevail.

Payment card information is always encrypted during transfer over networks.

We are not responsible if information made available on this site is not accurate, complete or current. Prices for our products are shown in pounds sterling and, where applicable, include UK VAT at the prevailing rate. Delivery charges are shown separately at checkout.
Prices for our products are subject to change. Any change will not affect an order we have already accepted.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service, except where such liability cannot be excluded by law.
SECTION 5 - PRODUCTS OR SERVICES
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only in accordance with our Refund Policy and your statutory cancellation rights.
We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your device's display of any colour will be accurate. Natural fabrics such as Liberty Tana Lawn may also show slight variation between batches.
We reserve the right, but are not obliged, to limit the sale of our products or Services to any person, geographic region or jurisdiction, and to limit the quantities of any products or Services that we offer.
SECTION 6 - ORDERS, BILLING AND ACCOUNT INFORMATION
Your order is an offer to buy from us. A contract between you and Crossrow Ltd is formed only when we send you a dispatch confirmation email. Our order confirmation email is an acknowledgement of receipt and does not constitute acceptance of your order.
We reserve the right to refuse or cancel any order. We may, at our discretion, limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, the same payment card, or the same billing and/or delivery address. If we cancel an order, we will refund any payment taken in full. We reserve the right to limit or prohibit orders that, in our reasonable judgement, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to keep it updated so that we can complete your transactions and contact you as needed.

SECTION 7 - YOUR RIGHT TO CANCEL
If you are a consumer in the UK or EU, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason. You then have a further 14 days to return the goods to us. Refunds will be issued in accordance with our Refund Policy. This right does not apply to goods that are made to your specification or clearly personalised, or to goods that are not suitable for return for reasons of hygiene once unsealed.
These cancellation rights are in addition to your rights under the Consumer Rights Act 2015 in respect of goods that are faulty, not as described, or not of satisfactory quality.
SECTION 8 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools, except where such liability cannot be excluded by law.
We may also, in the future, offer new Services and/or features through the website. Such new features and/or Services shall also be subject to these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trade mark, privacy, personality or other personal or proprietary right, and will not contain libellous or otherwise unlawful, abusive or obscene material, or any computer virus or other malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy.

Your submission of personal information through the store is governed by our Privacy Policy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice (including after you have submitted your order).
Where a pricing error is obvious and could reasonably have been recognised by you as a mispricing, we are not obliged to supply the goods at the incorrect price. In that case we will contact you to confirm whether you wish to proceed at the correct price, and if we cancel the order we will refund you in full.

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to breach any applicable laws, regulations or rules; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate on the basis of any protected characteristic; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We reserve the right to terminate your use of the Service for breaching any of the prohibited uses.
SECTION 14 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory rights in relation to the goods, including the right to receive goods which are as described, fit for purpose and of satisfactory quality; or (d) any other liability which cannot be excluded or limited under English law.
Subject to the paragraph above, we do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from use of the Service will be accurate or reliable. From time to time we may remove the Service for indefinite periods or cancel it at any time.
Subject to the first paragraph of this Section, if we fail to comply with these Terms we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. We do not supply products for business use, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Where you are a consumer, our total liability to you in respect of any order shall not exceed the total price paid for that order, save in respect of the liabilities set out in the first paragraph of this Section.
SECTION 15 - INDEMNIFICATION
If you are using the site other than as a consumer, you agree to indemnify, defend and hold harmless Crossrow Ltd and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party. This Section does not apply to consumers.
SECTION 16 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 17 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If we reasonably consider that you have failed to comply with any term or provision of these Terms, we may terminate this agreement at any time and you will remain liable for all amounts due up to and including the date of termination, and/or we may deny you access to our Services (or any part thereof).
SECTION 18 - ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written (including any prior versions of these Terms). This does not affect your statutory rights.
SECTION 19 - GOVERNING LAW AND JURISDICTION
These Terms and any separate agreements whereby we provide you Services are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you reside. If you are a consumer resident outside the United Kingdom, you retain the benefit of any mandatory protections available to you under the law of your country of residence.

Changes will not apply retrospectively to orders we have already accepted.
